1. About Roomee

Roomee is an online platform operated by Roomee Pty Ltd (ACN 656 887 624), a company registered in Victoria, Australia ("Roomee", "we", "us", or "our"). Roomee connects people looking for rental accommodation ("Seekers") with those who have rooms available to rent ("Landlords"). Our contact email is support@roomee.com.au.

By accessing or using our website and services (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Platform.

2. Eligibility

You must be at least 18 years of age to create an account or use the Platform. This requirement reflects the age of majority under the Age of Majority Act 1977 (Vic) and the fact that tenancy arrangements constitute legally binding contracts. By registering, you confirm that you are 18 or older and have the legal capacity to enter into these Terms.

3. Platform Role — We Are Not a Party to Tenancy Agreements

Roomee is a marketplace platform only. We facilitate connections between Seekers and Landlords but are not a party to any rental, tenancy, or accommodation agreement made between users. We do not own, manage, or control any properties listed on the Platform.

Any arrangement, agreement, or dispute arising from a tenancy is solely between the Seeker and the Landlord. Roomee accepts no responsibility or liability for the accuracy of listings, the conduct of users, the quality or condition of properties, or any tenancy outcome.

4. Account Registration

You must provide accurate and current information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at support@roomee.com.au if you suspect unauthorised access to your account.

5. Acceptable Use

When using the Platform, you must not:

• Post false, misleading, or fraudulent listings (including scam listings).
• Use the Platform for any purpose other than advertising rooms for rent or searching for accommodation.
• Discriminate against any user on the basis of race, sex, age, disability, religion, national origin, sexual orientation, or any other characteristic protected under the Equal Opportunity Act 2010 (Vic) or applicable Commonwealth law.
• Harass, threaten, or harm other users.
• Attempt to circumvent any security feature of the Platform.
• Scrape, copy, or resell any content from the Platform without our written consent.

6. Content and Listings

You are solely responsible for any content you submit, including listing descriptions, photos, and messages. By submitting content, you grant Roomee a non-exclusive, royalty-free licence to display, reproduce, and distribute that content on the Platform for the purposes of operating the service.

We reserve the right — but are not obligated — to review, edit, or remove any content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable.

7. Enforcement — Suspension and Termination

We reserve the right to suspend or permanently ban any account, and remove any listing, at any time and without prior notice if we determine that you have breached these Terms or are otherwise acting in a manner harmful to the Platform or other users. You may request a review of any enforcement decision by contacting support@roomee.com.au.

8. Fees and Payments

The Platform is currently free to use. We reserve the right to introduce fees for listing or accessing certain features at any time. We will provide reasonable advance notice of any new fees via the email address associated with your account.

All fees are non-refundable unless otherwise required by applicable law, including the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)).

9. Privacy and Data

Your use of the Platform is also governed by our Privacy Policy, which we will publish separately. We may use third-party analytics and advertising services to help us understand how the Platform is used and to display relevant content. These services may collect data such as IP addresses, browser type, and pages visited in accordance with their own privacy policies.

10. Intellectual Property

The Roomee name, logo, branding, and all Platform content created by Roomee (excluding user-submitted content) are the intellectual property of Roomee Pty Ltd. You may not use our intellectual property without our prior written consent.

11. Disclaimers and Limitation of Liability

The Platform is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or that listings will be accurate or up to date.

To the maximum extent permitted by law, Roomee's liability to you for any claim arising from your use of the Platform is limited to the fees (if any) you have paid us in the 12 months preceding the claim. Nothing in these Terms limits liability that cannot be excluded under the Australian Consumer Law.

12. Governing Law

These Terms are governed by the laws of Victoria, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of Victoria and the Federal Court of Australia.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice on the Platform. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
